Definitions

In these conditions the following terms have the following meanings:
Reflection period: the period within which the consumer can exercise his right of withdrawal;
Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
Day: working day;
Duration transaction: a distance contract with regard to a series of products and / or services, the delivery and / or purchase obligation of which is spread over time;
Durable data carrier: any means that enables the consumer or entrepreneur to store information that is addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Model form: the model withdrawal form that the entrepreneur makes available that a consumer can fill in when he wants to use his right of withdrawal.
Entrepreneur: the natural or legal person who offers products and / or services to consumers at a distance;
Distance contract: an agreement in which, within the framework of a system for distance selling of products and / or services organized by the entrepreneur, up to and including the conclusion of the agreement, use is exclusively made of one or more techniques for distance communication;
Technology for distance communication: means that can be used for the conclusion of an agreement, without the consumer and entrepreneur having come together in the same space at the same time.
General Terms and Conditions: the present General Terms and Conditions of the entrepreneur.

Applicability

These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and orders between entrepreneur and consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that the general terms and conditions can be viewed by the entrepreneur and they will be sent free of charge at the request of the consumer.
If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can can be easily stored on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be consulted electronically and that they will be sent free of charge electronically or otherwise at the request of the consumer.
In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply mutatis mutandis and in the event of conflicting general terms and conditions, the consumer can always rely on the applicable provision that is most appropriate to him. is beneficial.
If one or more provisions in these general terms and conditions are in whole or in part void or destroyed at any time, the agreement and these terms and conditions will continue to apply and the provision in question will immediately be replaced by a provision that, in consultation, from the original as close as possible.
Situations not covered by these terms and conditions should be assessed "in the spirit" of these terms and conditions.

The offer
If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
The offer is without obligation. The entrepreneur is entitled to change and adjust the offer.
The offer contains a complete and accurate description of the products and / or services offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If the entrepreneur uses images, they are a true representation of the products and / or services offered. Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.
All images, specifications and data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.
Pictures with products are a true representation of the products offered. The entrepreneur cannot guarantee that the colors displayed exactly match the real colors of the products.
Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer. This concerns in particular:
the price including taxes;
any shipping costs;
the way in which the agreement will be concluded and which actions are required for this;
the method of payment, delivery and implementation of the agreement;
the period for accepting the offer, or the period within which the entrepreneur guarantees the price;
the level of the rate for distance communication if the costs of using the technique for distance communication are calculated on a basis other than the regular basic rate for the means of communication used;
whether the contract is filed after conclusion, and if so, how it can be consulted by the consumer;
the way in which the consumer, before concluding the contract, can check the data provided by him under the contract and repair it if desired;
any other languages ​​in which, in addition to Dutch, the contract can be concluded;
the codes of conduct to which the entrepreneur is subject and the way in which the consumer can consult these codes of conduct electronically; and
the minimum duration of the distance contract in the event of an extended transaction.

Delivery
Tankkd.store works with an external transport company. We pass on the estimated delivery time to the customer that we obtain from the transport company. Tankkd.store is not responsible for delays and/or damage to the products (unless the packaging does not comply).
Upon delivery, the consumer must check the packaging and, if there is any damage, report this on the delivery document of the driver of the delivery company and take photos of the damaged packaging / products.
In the event of damage, the consumer must also report this to Tankkd.store within 24 hours by email, including proof (photos).

Money Back Guarantee
We offer a 14-day money-back guarantee on our products. If you are not satisfied with your purchase, you can return it within 14 days of the delivery date for a full refund. To be eligible for a return, the product must be in its original packaging, unused or tested, and in the same condition that you received it. The customer is responsible for the shipping costs of returning the item to Tankkd.store.

Returns and Refunds
If you wish to return a product, please contact us at tankkdstore@gmail.com within 14 days after delivery. The customer is responsible for the cost of shipping the returned product to tankkd.store as well as the shipping cost made by tankkd.store at the purchase. Once we receive and inspect the returned product, we will process the refund within a reasonable time when not damaged. The refund will be credited to the original payment method used for the purchase.

In case of damage when returning the products, Tankkd.store will determine in a fair manner what percentage can be refunded in order to be able to resell the product at a reduced price.
Custom made products (wooden covers, painted tanks,...) will be refunded at 50% of the original price.

Any defects or incorrectly delivered products must be reported to the entrepreneur in writing within 24h of delivery. Return of the products must be in the original packaging and in new condition.

If technical problems arise with electronic devices, the seller will find a solution to solve the problem. If the customer refuses and wants to return the product, the transport costs are for the customer.
If no solution can be provided by the seller or if the device needs to be replaced, the transport costs will be paid by the seller.
Costs in case of withdrawal
If the consumer makes use of his right of withdrawal, at most the shipping cost of return will be for his account as well as the shipping cost when purchasing the products won't be paid back.
If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after cancellation. This is subject to the condition that the product has already been received back by the online retailer or conclusive proof of complete return can be submitted.

Exclusion of right of withdrawal
The entrepreneur can exclude the right of withdrawal of the consumer for products.
Exclusion of the right of withdrawal is only possible for products that have been created by the entrepreneur in accordance with the consumer's specifications; for example specific painting on the tank, wooden cover, liner in the tank.

Disputes
Only Portuguese law applies to agreements between the entrepreneur and the consumer to which these general terms and conditions apply. Even if the consumer lives abroad.
Additional or different stipulations
Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable medium.
